Terms & Conditions

Welcome to Ifor Williams Trailers NZ Elders (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of iforwilliamselders.co.nz (the “Site”) and any products or services we offer, including trailers, horse floats, parts, accessories, and related services across the North Island of New Zealand. By using the Site or placing an order with us, you agree to these Terms.

We are an authorised North Island distributor of Ifor Williams Trailers (UK).

2. Using this Site

  • You may use the Site for lawful purposes only.

  • We may update, restrict, suspend, or discontinue any part of the Site without notice.

  • Content on the Site (specs, images, copy, downloads) is provided in good faith for general information.
     

3. Quotes, orders & acceptance

  • Quotes are invitations to treat, not offers. We may revise or withdraw a quote prior to acceptance.

  • An order is accepted only when we issue a written confirmation (email/invoice) or receive a deposit (see Section 5).

  • Stock is subject to availability. Factory build slots and lead times are indicative only.
     

4. Pricing, GST & currency

  • Unless stated otherwise, prices are in NZD and include GST.

  • We may correct pricing or typographical errors at any time. If a pricing error affects a confirmed order, we’ll offer you the choice to proceed at the correct price or cancel with a refund of any deposit paid.
     

5. Deposits & payments

  • Deposits (if required) secure stock/build slots and are non-refundable except where required by law or if we cancel.

  • Balance is due prior to collection/delivery unless otherwise agreed in writing.

  • Title to goods remains with us until payment is received in full. We may register a security interest under the PPSA.
     

6. Delivery, collection & risk

  • We offer North Island delivery; timing and cost are provided at order stage. Delivery timeframes are estimates only.

  • Risk passes to you on delivery to your address or on collection from our premises. Please inspect on arrival/collection and notify us of any issues within 48 hours.
     

7. Product specifications & suitability

  • Model names, specifications, dimensions, and features may change due to ongoing manufacturer updates.

  • You are responsible for ensuring the product’s suitability for your intended use (including tow ratings, load limits, licensing, WOF/COF, and any specialist fit-out).
     

8. Parts & accessories

  • Genuine parts and accessories are offered via our Parts Store. Part numbers and compatibility should be confirmed against your VIN/model year. Electrical and safety-related parts should be installed by competent persons.
     

9. Accuracy of information

  • While we aim for accuracy, errors and omissions may occur. Images may show optional equipment. Where a discrepancy exists between the Site and your final order/invoice, the order/invoice prevails.
     

10. Warranties & your rights

  • Manufacturer warranty terms apply to new trailers/horse floats and will be provided on request or at purchase.

  • Your rights under the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA) apply and are not excluded by these Terms.

  • For business customers acquiring goods in trade, you agree the CGA does not apply to the extent permitted by section 43 CGA.
     

11. Returns, remedies & damages

  • For change-of-mind returns, we are not obliged to accept a return.

  • If goods are faulty or not as described, we will meet our obligations under the CGA/FTA, which may include repair, replacement, or refund.

  • To start a claim, contact us with your order details, photos, and a description of the issue.
     

12. Finance & third-party services

  • Any finance information on the Site is indicative only and subject to approval by third-party lenders.

  • If you proceed with finance, your agreement is with the lender; their terms and privacy practices apply.
     

13. Website availability & liability

  • The Site is provided “as is”. We do not guarantee uninterrupted or error-free access.

  • To the maximum extent permitted by law, we are not liable for indirect or consequential loss (including loss of profit, business, or data) arising from your use of the Site or delays in supply.

  • Nothing in these Terms limits liability where it cannot be excluded under NZ law.
     

14. Intellectual property

  • All content on the Site (text, images, graphics, trademarks, logos) is owned by us or our licensors and may not be copied, distributed, or modified without our prior written consent.
     

15. Privacy & cookies

  • We handle personal information in accordance with the Privacy Act 2020 and our Privacy Policy (available on the Site).

  • The Site may use cookies and similar technologies for functionality and analytics. You can control cookies via your browser settings.
     

16. Safety, compliance & modifications

  • Always use trailers and floats in accordance with the manufacturer’s instructions and relevant NZ road regulations.

  • Any post-sale modification may affect compliance, warranty, and safety; seek advice before making changes.
     

17. Force majeure

  • We are not liable for failure or delay caused by events beyond our reasonable control (e.g., supply chain disruption, transport delays, extreme weather).
     

18. Changes to these Terms

  • We may update these Terms at any time by posting the revised version on the Site. Your continued use constitutes acceptance of the changes.


19. Governing law

  • These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
